TERMS OF SERVICE

These Terms of Service govern your access to and use of the website, client galleries, photographs, downloads, and related services provided by Hey Lisbeth Photography.

1. Gallery Access

Client galleries may contain private photographs and may be protected by a password or download PIN. Access information is intended only for the client and authorized guests. You are responsible for keeping passwords and PINs confidential.

2. Copyright and Ownership

All photographs and visual content are protected by copyright and remain the property of Hey Lisbeth Photography unless otherwise stated in a written agreement. Purchasing a session, print, product, or digital image does not transfer copyright ownership.

3. Permitted Use

Downloaded photographs are licensed for the client’s personal, non-commercial use. Clients may display, print, and share their photographs on personal social media accounts. Reasonable cropping required by a social media platform is permitted, but photographs may not be materially altered, edited with filters, sold, entered into contests, used for advertising, or provided to another business without written permission.

4. Downloads and Products

Clients are responsible for downloading and safely backing up their photographs before the gallery expiration date. Hey Lisbeth Photography cannot guarantee that expired galleries or lost files will remain available indefinitely. Print color, cropping, and quality may vary when products are ordered from outside laboratories or vendors.

5. Prohibited Conduct

You may not copy, download, distribute, reproduce, modify, access, or use photographs belonging to another client without authorization. You may not attempt to bypass gallery security, interfere with the website, or use its content for unlawful purposes.

6. Gallery Availability

We make reasonable efforts to keep galleries accessible and accurate, but temporary interruptions, maintenance, technical failures, or circumstances beyond our control may occur. Gallery availability and expiration periods may also be governed by the client’s photography agreement.

7. Other Agreements

These Terms apply to the website and client galleries. Session payments, cancellations, rescheduling, image delivery, model releases, and other photography services are governed by the separate agreement accepted by the client. If these Terms conflict with a signed photography agreement, the signed agreement will control.

8. Limitation of Liability

To the fullest extent permitted by law, Hey Lisbeth Photography will not be liable for indirect, incidental, or consequential losses arising from the use or temporary unavailability of the website or gallery. Nothing in these Terms limits rights that cannot legally be waived.

9. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

10. Changes and Contact

We may update these Terms when our services or legal requirements change. The effective date above will indicate the latest revision.
